Another week and another hot topic for the industry has kept us busy taking many calls in regard to the fuel excise changes. Thank you for the positive feedback about the information we provided for members to better understand the implications of how this impacts your business, and importantly how to communicate this to your clients.
It has been very encouraging to also hear that plenty of members have been seeking immediate advice from their accountants to understand cash flow variations and the implications for your fuel levies/surcharges.
The Federal Government's decision to reduce the fuel excise has lead to various interpretations on how this has impacted the road freight industry. We provided a view that clearly articulated the relationship between the excise and the road user charge to indicate the modest benefit to the road freight industry compared to the general motorist.
This approach to the excise reduction without consideration of reducing the road user charge has left this industry being treated unfairly. It is our firm position that the road freight industry should be receiving the same benefit 50% reduction as the general motorist.
We are strongly advocating on your behalf for a 50% reduction in the road user charge. If it is fair for a 50% reduction to the excise for the general motorist then the same should apply to road freight.
I strongly urge you all to play a role by contacting Local Members and let them know what you think as well. Many voices, one clear message. Send them a copy of our Budget Issue with your message.
It is fundamentally important to band together and spread a consistent message.

Fuel Price Reports - RACQ

RACQ publishes Monthly and Annual fuel price reports. These can be found here: www.racq.com/fuel
These reports publish RULP91, P95, DSL and LPG average prices for Greater Brisbane (and the other capitals), and RULP91 and DSL for the Gold and Sunshine Coast, and about 30 regional centres.
This information may be helpful when discussing freight rates and fuel levies.

First successful industrial manslaughter prosecution against individual
|
|
|
|
Following on from a previous article about this case, Jeffrey Owen was last Friday convicted and sentenced after a four day jury trial to five years jail, to be suspended after serving 18 months in prison, the charge having carried a maximum penalty of 20 years imprisonment.
This is the first time an individual has been prosecuted, convicted and jailed for industrial manslaughter since the offence was introduced in Queensland in 2017 (see s 34C of the Work Health and Safety Act 2011 (Qld)). The only other successful prosecution to date has been against a company (see article here).
The conviction related to an incident on 3 July 2019 at Owen's Electric Motor Rewinds in Gympie, Queensland, where Mr Owen negligently caused the death of a worker when a forklift was overloaded, tipped and fatally struck the worker. Specifically, it was alleged that Mr Owen was not licensed to operate the forklift and the forklift did not have sufficient lifting capacity to unload the generator from the truck, the rear wheels of the forklift having come off the ground when it took on the load. The business also had no documented health and safety procedures. In addition, there were other methods which were available to the business to unload the generator (at little cost) that weren't used by the business.
While all industrial manslaughter convictions to date have involved small companies with little to no safety management systems, this case still serves a timely reminder to all corporate officers and managers (not just directors) that they need to continue to 'ensure' that due diligence systems are both carried out carefully and reviewed regularly, in order to avoid the very real risk of large fines and/or potential custodial sentences for individuals for serious incidents and fatalities in the workplace.

Heart of Australia secures funding for services

|
Heart of Australia has received a major funding commitment of $17.2 million from the Federal Government to guarantee its mobile medical clinics will continue to service regional and rural Queenslanders for the next four years.
Founder and cardiologist, Dr Rolf Gomes, said he is thrilled Heart of Australia’s five mobile clinics will continue to provide improved access to specialist medical services for Queenslanders living in remote and regional areas of the state.
“I would especially like to thank the Minister for Regional Health, Dr David Gillespie, for his unwavering commitment and advocacy to ensure funding for Heart of Australia to continue delivering services for regional Queenslanders was included in the 2022-2023 Federal Budget,” Dr Gomes said.
“Having the continued support from the Federal Government can give Queenslanders living in rural and remote areas the confidence we will continue to be there for them, no matter what,” he said.

How to record personal use of fatigue related Heavy Vehicles
|
|
|
It is a requirement that drivers record when they use the personal use exemption in their work diary. If they do not do this, the exemption will not apply and any additional time used for permitted personal activities may cause a breach of work and rest limits.
To record work time used under the personal use exemption, drivers using a written work diary must:
- Stop their current daily sheet as they are swapping work and rest options and start a new (the next consecutive) daily sheet.
- Nominate exemption hours as the work and rest option on the new daily sheet.
- Note the use of the exemption in the Comments section of the new daily sheet by writing “Personal use exemption” or “Permitted personal activity” and include the start and finish time of the permitted personal activity.
- Record the extra work time as work on the new daily sheet (including relevant details like place and odometer reading). If a driver uses the personal use exemption on a calendar day and wants to swap back to standard hours, they must follow the same procedure as above, but nominate standard hours as their work and rest option on the next consecutive daily sheet
Examples of permitted personal activities
It is impossible to list all the situations when a driver may need to use their FRHV for personal permitted activities. However, the following are examples of activities that would fit with the definition of permitted personal activities in the exemption:
- driving the heavy vehicle to reach accommodation for the driver
- driving the heavy vehicle to purchase goods or services for use by the driver, such as food and beverages, medical support and supplies, banking or post office facilities.
- washing or cleaning a heavy vehicle owned by the driver
- stowing clothes and food in the cab of the heavy vehicle for use by the driver
- driving the heavy vehicle as part of a historic vehicle event
- repairing or fuelling the heavy vehicle so that it can be used for other permitted personal activities.

Australian Industry Standards have released draft training products for the following projects and are inviting feedback:
- Electric Heavy Vehicle Project – Final draft training materials are now available for comment. These include two units of competency designed to address the required skills and knowledge for operating an electric bus or heavy vehicle. Feedback is invited up to close of business Friday 8 April 2022.
- Mobile Crane Operations Project – Draft training materials are now available for comment. The Certificate III and Certificate IV in Mobile Crane Operations and associated Units of Competency have been revised to address changes in technology, transport related activity risk factors and regulations associated with the role of a mobile crane operator. Feedback is invited up to close of business Tuesday 26 April 2022.

The Australian and New Zealand Standard Classification of Occupations (ANZSCO) is a skill-based classification used to categorise all occupations. It is used to collect data in a range of applications including vocational education and training and skilled migration programs.
The Australian Bureau of Statistics is conducting a review of occupation classifications and their corresponding skill requirements. The public consultation is now open for feedback, closing 12 April 2022.

Fast and free digital training
All Australian workers now need some level of digital skills aligned to tasks such as recording orders, deliveries, timesheets and budgets.
The Digital Skills Organisation is delivering a pilot program offering free short, practical online training developed with industry, reflecting in-demand skills and designed to ensure workplace relevance.
On average the program takes around 20 hours, is delivered online and can be done at a pace to suit busy employees with no disruption to normal day-to-day work. It is best done on a laptop or personal computer, but a tablet or mobile phone can also work.
The training is free of charge until 30 June 2022 and is a great opportunity to increase the digital skills of your workforce.

The Growing Workforce Participation Fund is part of the revitalised Back to Work program. It aims to develop partnerships with industry to build longevity and sustainability in the workforce by empowering industry and employers to support jobseekers from identified groups experiencing greater disadvantage in the labour market.
Grant funding of $20,000 up to $200,000 is available for industry and eligible organisations to trial new approaches aimed at creating improved job matching, industry specific pre-employment pathways and the development of resources for both jobseekers and employers.
Applications are now open, closing 9 May 2022.

Now is the time to take on a new apprentice or trainee.
The Boosting Apprenticeship Commencements scheme provides support to employers to take on new apprentices and trainees. Eligible employers can access a subsidy of 50% of wages paid to a new or recommencing apprentice or trainee, for a 12 month period from the date of commencement.
After 12 months, the support will be eligible to move to the Completing Apprenticeship Commencements subsidy which provides a 10% wage subsidy for the second year and a 5% wage subsidy for the third year of an apprenticeship or traineeship.
The Australian Government announced on 27 March 2022, that the Boosting Apprenticeship Commencement scheme will be extended to 30 June 2022. Read the media release here.

Port Drive - Changed traffic conditions, 5 April 2022

Motorists, please be advised that there will be traffic control on Port Drive on Tuesday 5 April 2022 from 6.00am to 3.00pm, weather permitting.
Contractors will be installing new signage on the edge of Port Drive between Kite St and Captain Bishop Bridge (inbound). The works will be in close proximity to traffic, and we request that all drivers comply with and respect all traffic management controls.

- Port Drive overpass inbound
What to expect
- Partial lane closure on Port Drive inbound (Kite Street overpass)

SEQ: Pacific Motorway, Burleigh - Closure at Exit 87 Interchange
|
From 8pm Friday 1 April to 6am Monday 4 April, the exit 87 interchange at Burleigh will be closed to all M1 traffic to allow for construction of the new Diverging Diamond Interchange (DDI) as part of the Varsity Lakes to Tugun M1 upgrade.
Restrictions
- No access from industrial area (Junction Road or Southport-Burleigh Road) to the M1.
- No access from M1 northbound offramp to industrial area (Hutchinson St) – Bridges are closed.
- No access from Southport-Burleigh road to exit 87 interchange.
- No access across the interchange in either direction.
Please note:
- M1 (North & Southbound) traffic is unaffected during this time.
- M1 Southbound offramp to industrial area remains open.

SQW: Temporary Closure and Detour - Carrington Rd, Toowoomba

Effective 12.30pm Saturday 9 April 2022 to 5.00am Monday 11 April 2022, there will be a temporary closure at the Carrington Road, Robson-Hursley Road and Moore Road intersection.
Vehicles are permitted to detour via Boundary Street, Bridge Street (Toowoomba Connection Road) and Troys Road (Charlton Connection Road).
The closure will be in place to accommodate works for a nearby commercial development.
You must check the Conditions of Operation Database before you start your journey.
