Safety Breaches and Fairness – the cost of inconsistency  

A recent Fair Work determination has examined the need for a consistent approach when managing safety compliance and taking disciplinary action. In finding that an employee had been unfairly dismissed, the employer’s argument for dismissal on safety grounds was not compelling in the face of evidence suggesting that were complicit in those safety breaches.
